Maternity Leave
The following is a very brief outline of the Maternity Leave provisions. If members want further detailed advice or have any queries at all they are STRONGLY ADVISED to contact Regional Office.
What leave am I entitled to?
If you have one year's continuous service (or more) you are entitled to 26 weeks paid leave and a further 26 weeks unpaid leave.
If you have less than one year's continuous service you are entitled to 26 weeks unpaid leave during which you may qualify for Statutory Maternity Pay. If you have 26 weeks continuous service at the end of the eleventh week before the expected week of child birth you will be entitled to a further 26 weeks leave.
What will happen to my pay?
- During the first 4 weeks you will be on full pay (inclusive of Statutory Maternity Pay).
- For the next two weeks (5 and 6) you will be on 9/10ths of your salary (inclusive of Statutory Maternity Pay).
- For the next twelve weeks (7-18) you will be on half pay plus Statutory Maternity Pay.
- For the remaining 8 weeks you will receive your Statutory Maternity Pay entitlement.
When can maternity leave begin?
The earliest a teacher can begin her maternity leave is the eleventh week before the baby is due. However, you do not have to begin your leave then. You can choose to work on beyond this date but should consult you doctor to ensure that you are fit to do so.
Salary ceases and maternity pay begins on the day your absence begins irrespective of whether or not it is a school holiday.
When should I give notice?
You should give notice at least fifteen weeks before you intend to commence your maternity leave by completing an application form available in your school. Ask for a copy of the LEAs document "Maternity Provisions for Teachers" at the same time.
What about my return to work?
It is assumed that you will be returning to work at the end of your maternity leave. You have the right to return to work in the job in which you were employed. If you change your mind you should let the school know as soon as possible.
Leicester has a job-sharing scheme for all staff and you may wish to consider using the provisions of this scheme on your return. Discuss the possibility with you Headteacher or Principal. If you encounter and difficulties contact a local Officer.
If you return part-time remember that you will need to elect to have this employment treated as pensionable.
