We reproduce below Leicester Education Authority's current procedure.
1) Statutory sick pay is paid for a period of 196 days (28 weeks). The first three days of sickness absence are not included in this period, the period does not include holidays and weekends. The current level of SSP is £60.20, this figure is amended on 1 April each year in the Statutory Sick Pay Tables issued by the Inland Revenue.
2) If an employee's salary is below the lower earnings limit for National Insurance contributions, currently £67.00 (amount reviewed on 1 April each year), then there is no entitlement to statutory sick pay. In these cases the payroll department will issue an SSP1 form, this allows the employee to claim incapacity benefit.
3) If the employee's entitlement to SSP ends before they return to work then the payroll department will issue an SSP1 form.
4) When the employee returns to work on a therapeutic basis statutory sick pay is no longer payable. However, the amount will continue to be paid as 'benefit lost', provided that this dies not take the employee's earnings above their normal weekly salary. The amount of benefit paid will be reduced as the employee's hours and earnings increase, to ensure that the employee receives no more than their normal weeks pay.
5) The days that are worked during a therapeutic return are not counted against the employee's entitlement to sick pay, those days which are not worked are still counted as sick leave.
6) The entitlement to sick pay varies according to job and length of service and this entitlement is laid down in the employee's terms and conditions of service. Any questions regarding sick pay entitlement should be directed to your school's Human Resources officer, or the appropriate payroll clerk.
NOTE: The level of statutory sick pay increased to £62.20 with effect from 1 April 2001.
The lower earnings limit for National Insurance Contributions increased to £72 with effect from 1 April 2001.
